Contest a Parking Citation

A vehicle owner/operator who believes that a citation has been issued in error may appeal a citation by requesting an Administrative Review within 21 calendar days from the citation issue date. Appeal online at the Citation Processing Center website or submit a written statement (with any supporting documentation and/or photographs) to the P.O. Box address listed above.

Contest an Administrative Citation

You may request an Administrative Hearing by filing a signed copy of the citation and request a hearing with the City of Duarte Public Safety Department, located at 1042 Huntington Drive., Duarte, CA 91010 within 10 days of the date of the citation.

IMPORTANT: You must advance deposit the fine and an additional $50.00 non-refundable administrative appeal fee with the Public Safety Department when you file for your request for an administrative hearing.

Indigent Payment Plan

A Registered Owner/Lessee has an option to enroll in an Indigent Payment Plan with proof of indigent status.

An “indigent” person is defined as a person who is receiving public benefits under one or more of the following programs: 

  1. Supplemental Security Income (SSI)

  2. State Supplementary Payment (SSP)

  3. California Work Opportunity and Responsibility to Kids Act (CalWORKs)

  4. Tribal Temporary Assistance for Needy Families (Tribal TANF)

  5. Supplemental Nutrition Assistance Program or the California Food Assistance Program (Food Stamps)

  6. County Relief, General Relief (GR), or General Assistance (GA)

  7. Cash Assistance Program for Aged, Blind, and Disabled Legal Immigrants (CAPI)

  8. In-Home Supportive Services (IHSS)

  9. Medi-Cal

  10. California Special Supplemental Nutrition Program for Women, Infants, and Children (WIC Program)

  11. Unemployment compensation

An Indigent Payment Plan provides the option to pay your parking citation in up to $25.00 monthly increments and shall be paid off in 24 months of the Indigent Payment Plan approval date.  The Indigent Payment Plan application must be received within 120 calendar days of issuance of the citation, or within 10 calendar days of an administrative hearing determination, whichever is later.  Upon approval, a non-refundable payment plan fee of $5.00 will be assessed to the total Indigent Payment Plan amount and late fees and penalties shall be waived.  Waived late fees and penalties may be reinstated if the person falls out of compliance with the Indigent Payment Plan.

Proof of Indigence

To qualify for the Indigent Payment Plan, the Registered Owner/Lessee must demonstrate that he or she is indigent by providing either of the following information:

  1. Proof of Income from three (3) most recent pay stubs that show the individual meets the income criteria set forth in subdivision (b) of Section 68632 of the Government Code.

  2. Verification of Benefits Form for Public Assistance or Award Letter for Social Security.  Proof of receipt of benefits under the programs described in subdivision (a) of Section 68632 of the Government Code.

  3. If the Registered Owner/Lessee has No Income or does not receive Public Assistance, a copy of their yearly earnings from the Social Security Department is required.
