Abandoned Shopping Cart

Duarte Municipal Code Section 9.70

Beginning August 28, 2009, the City of Duarte adopted an ordinance to deal with the problems of abandoned shopping and laundry carts. Per Duarte Municipal Code 9.70, no person may remove, alter, convert or tamper with any cart belonging to a business. Furthermore, every business must have a cart retention and retrieval program.

Business Enforcement

Under the ordinance, businesses are required to implement and maintain a cart retention and retrieval program. Failure of a business to maintain a cart program may result in fines ranging from $100 to $500 for each occurrence. In addition, if a cart is not retrieved by the business and is subsequently retrieved by the City, the businesses may be charged $110 per cart fee.

Persons Removing Shopping Cart(s) and or Laundry Cart(s)

Persons found in possession of shopping or laundry cart(s) outside the premises of the owner or caught removing a cart from the business’s parking lot without permission, may be issued a citation. The fine amount for the first offense will be $100, second offense will $200, and $500 for every subsequent offense.
